Abstract
“Platform proceedings” instead of “platform liability”. This book is not dedicated to the justifications and prerequisites for the responsibility of online platforms for the content of their users. It takes the next step and focusses on the legal design of content moderation. To this end, moderation is understood and systematised as a procedure in the legal sense. This includes its procedural law containing parts of the DSA, UrhDaG, P2B-VO, TCO-VO and the contracts of the platform operators. Platforms must not only aid in enforcing the law, but also mind a complex interplay of communication and protection interests. The optimising procedural principles proposed in the book, e.g. for fairness, hearings or acceleration, help in this respect.
