dc.description.abstractThe two studies brought together in this volume offer two dogmatic approaches to the legal institution of National Heritage. The first examines the unique position that this institution occupies within the framework of public affairs. Contrary to the thesis – which is widely accepted in our doctrine – that has sought to reduce this position to a subcategory of the public domain or the patrimonial assets of the State, the study defends the distinct and differentiated status of National Heritage. The second study, for its part, attempts to reconstruct the legal history of the Royal Patronages with the aim of unravelling the reasons why a set of prerogatives with ecclesiastical and seigneurial roots have ended up forming a closed relationship of legal-public foundations linked to National Heritage. In both cases, the same methodological premise is used: the study of legal institutions cannot be separated from their consideration as historical and political artefacts.en_US

oapen.abstract.otherlanguageLos dos estudios reunidos en este volumen ofrecen sendas aproximaciones dogmáticas a la institución jurídica del Patrimonio Nacional. En el primero, se examina la singular posición que ocupa dicha institución dentro del entramado de las cosas públicas. Frente a la tesis –mayoritaria en nuestra doctrina– que ha pretendido reducir esa posición a una subcategoría del dominio público o de los bienes patrimoniales del Estado, se reivindica el estatus categorial propio y diferenciado del Patrimonio Nacional. El segundo trabajo, por su parte, trata de reconstruir la historia jurídica de los Reales Patronatos con el objetivo de desentrañar las razones por las que un conjunto de prerrogativas de raíz eclesiástica y señorial han acabado conformando una relación cerrada de fundaciones jurídico-públicas vinculadas al Patrimonio Nacional. En ambos casos se parte de una misma premisa metodológica: el estudio de las instituciones jurídicas no puede desligarse de su consideración como artefactos históricos y políticos.en_US
